This Court case concerned the violation of the right to livelihood of the Ogini people by the Nigerian Government. The community alleged that the Government through its military operations in the oil-rich area had prevented the community from having access to their farming land where they had been cultivating crops. the Commission held that the Government of Nigeria must ensure and protect the environment, health and livelihood of the people of Oginiland by putting in a number of measures which include, ensuring adequate compensation to victims of human rights violations, including relief and resettlement assistance to victims.
